LESSOR
TKCA Vacation Rentals, Providenciales, Turks and Caicos Islands, BWI.
PREMISES
Windchaser Villas (Alizé, Sirocco, Mistral, Bora), 2 Long Bay Beach Drive, Long Bay Hills, Providenciales, Turks and Caicos Islands, including but not limited to structure, contents, patio and stairs adjacent to structure, swimming pool and grounds. Lessor reserves the right to relocate guests in any of these equivalent villas (or upgrade) without notice.
DEPOSIT AMOUNT
A fifty percent (50%) deposit of the total rental fee, in US dollars, shall be paid upon signing the rental agreement. The Deposit amount shall be a credit toward the total Rental Fee due in full sixty (60) days prior to the arrival. If payment is not made, a reminder will be sent via email. After one (1) week, the rental agreement is null and void and the property goes back into the rental market.
OCCUPANCY
The total number of occupants shall not exceed 4 people + 2 kids under 12 years old.
The lessor reserves the right to charge the lessee $50 per extra person (+ 12 yrs old) per day for the length of stay provided occupancy does not exceed maximum stated and/or evict group or all extra persons who were not originally included in rental agreement.
WAIVER OF LIABILITY
Lessee and/or Lessee’s guests hereby voluntarily accept all risk of personal injury, death and/or property damage to Lessee and /or Lessee’s guests which occur on or about the PREMISES during said term of lease. Lessee further agrees to release and forever hold harmless Lessor and/or Lessor’s agents for any bodily injury, death and/or property damage sustained by Lessee and/or Lessee’s guests during said term of lease.
INDEMNIFICATION
Lessee agrees to indemnify Lessor for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any potential claim or litigation which may arise out of or in connection with Lessee use and occupancy of the premises during the term of lease and/or Lessee’s guests use and occupancy of the premises during said term of lease.
SWIMMING POOL
Lessee understands Lessor provides no lifeguard on premises. Lessee further understands that said use of pool is an inherently dangerous activity and assumes full responsibility for Lessee and/or Lessee’s guests own safety during said term of lease.
CHILDREN
Lessee assumes sole responsibility for the proper supervision of any children on the premises during said term of lease. Lessor expressly
disclaims that the premises are suited or otherwise designed for children or young adults who lack the maturity to recognize the inherent risks associated with the use of the swimming pool or the entering of a natural wilderness such as the ocean. Lessee is specifically advised not to allow children to swim or play in the swimming pool or the ocean without adult supervision.
CANCELLATION
In the event Lessee cancels sixty (60) days prior to the commencement of said term of lease, the deposit amount is fully refundable minus applicable banking fees. If Lessee cancels less than sixty (60) days prior to commencement of said term of lease, the rental amount is forfeited. The purchase of travel insurance to cover unexpected cancellations is recommended. Travel insurance provides coverage to protect Lessee from a wide array of unexpected events such as, but not limited to, unpredictable weather, medical or family emergency. Lessee is encouraged to give consideration to the purchase of travel insurance as there are circumstances that can cause renters to cancel or interrupt their stay thereby forfeiting any non-refundable pre-payments or payments made for their trip.
EVICTION, LAW and AGENCY
In the event Lessee breaches any term of this agreement Lessor reserves the right to evict Lessee without notice. No refund will be given to Lessee. Lessee and Lessor agree the laws of Turks and Caicos Islands, British West Indies, shall govern this agreement. Lessor or its designated agent may administer this agreement. Lessee agrees to release and forever hold harmless Lessor’s agent.
UTILITIES
The owner will cover up to $25.00/day (forty five US Dollars) for the electricity consumption. On the last day of this rental, the meter will be read and any amount over the allowance will be charged to the lessee, on their credit card, at a rate of $0.50 per KWH.
SEPTIC TANK
Lessee understands that we have septic tanks and that the grey water is reused in landscaping. There is no water treatment filters and facilities on the premises. Lessee therefore agrees to NOT flush anything else than toilet paper. Other hygiene and personal care products block the pipes and destroy the natural bacterial process which then inconveniences all guests on site when it's blocked and it overflows.
NON SMOKING / NO ANIMALS ALLOWED
The units are strictly non-smoking and no animals are allowed inside. Lessee will be charged a fine and a cleaning fee of $300.00 (three hundred) US dollars plus fees on their credit card if these rules are not respected.
SECURITY DEPOSIT
A security deposit of US $400 (four hundred US dollars) will be held on the Lessee’s credit card upon arrival. Upon departure, the property will be inspected and once verified there are no damages to the property and its contents and no loss of items, the security deposit will be released back to the Lessee’s credit card. Report any damages or loss immediately. If not, it will be assumed that damages and/or loss were caused by you and you will be charged accordingly. It is also expected for the lessee to leave the premises in good conditions and relatively clean. Failure to do so may incur extra cleaning charges that will be charged on your credit card after departure.
